Person short of breath and clutching their chest - Do You Know About Benedict's Law?

New UK legislation is set to require mandatory allergy safety measures in schools, and every parent and teacher needs to know about it.

Benedict’s Law is new UK legislation, expected to come into force in September 2026. It requires all schools to implement mandatory allergy safety measures to protect children with food allergies. The law takes its name from Benedict Blythe, a five-year-old boy who tragically died from an allergic reaction at his primary school in 2021, after staff mistakenly gave him milk.

What the Law Requires

Under Benedict’s Law, schools must maintain clear, whole-school allergy policies. Staff must also receive comprehensive allergy and anaphylaxis training. In addition, schools must keep spare emergency adrenaline auto-injectors on hand. Every pupil with a food allergy must also have an individual care plan.

Sadly, allergy-related tragedies have continued to happen, despite earlier changes to the law. Unlabelled ingredients, undisclosed cooking oils and cross-contamination have all led to serious incidents in the past. As a result, many venues now display allergen warnings and highlight ingredients clearly on packaging.

Recognising an Allergic Reaction

Anaphylaxis occurs when the body’s immune system releases a flood of histamine, sending the body into shock. Warning signs include tingling on the lips or tongue, swelling of the throat, wheezy breathing, and red, itchy hives. Dizziness, fainting and pale skin can also follow a sudden drop in blood pressure.

Anaphylaxis is always a 999 medical emergency. If someone shows these signs, help them lie down and call for help immediately. Reassure the casualty throughout, and ask whether they carry any medication, such as an EpiPen.
